Indian Permanent Residency – Long Term Immigration Services
Persons of Indian Origin (PIO Card)
The Persons of Indian Origin scheme (PIO) has been in force since 1999 and is designed to allow people who do not have a grant of Indian citizenship or permanent residency but can claim Indian parentage to settle in India. The PIO scheme applies to people of Indian origin as defined by their birth or that of one of their parents or grandparents. A PIO card is granted for 15 years and although it is not directly a grant of permanent residence, after seven years of normally residing in India in possession of a PIO card, a candidate may apply to become an Indian citizen. PIO cards apply to both the main applicant and their spouse and permit their holders to travel in and out of India as frequently as they choose, study in India without the need for an Indian student visa, and to undertake employment at they see fit.
Overseas Citizenship of India (OCI)
Overseas Citizenship of India (OCI) allows a Person of Indian Origin living overseas with a grant of citizenship in their country of residence, to gain many of the same rights as a full Indian citizen. Unlike the PIO Card, OCI does not apply to the spouse of a qualifying applicant; however, OCI is granted for life and offers the opportunity to apply for Indian citizenship after 5 years of residence. The OCI scheme is often incorrectly referred to as Indian ‘Dual Citizenship’. Whilst an OCI holder does receive many, though not all of the rights and privileges enjoyed by those with Indian citizenship, India does not support dual citizenship and OCI should not be viewed as such. Dual citizenship must be supported by both countries concerned in order to be valid, and since India does not support the practice an OCI holder who undergoes Indian naturalization for a grant of full citizenship must renounce citizenship of any country other than India.
